At this week’s divorce hearing, Nathan Wade, the prosecutor, may have been forced to address claims of having a romantic relationship with his boss, Fani T. Willis.

Following a temporary settlement in his divorce case on Tuesday, the special prosecutor in charge of the case involving alleged election meddling against former President Donald J. Trump will not be required to testify this week regarding a purported romantic relationship with his boss, Fulton County district attorney Fani T. Willis.

A question that has created potential risk for Ms. Willis’s high-profile prosecution of Mr. Trump and 14 of his allies has been left unanswered for the time being by the agreement between the special prosecutor, Nathan J. Wade, and his wife, Joycelyn Wade.

In 2021, Ms. Willis hired Mr. Wade, a private practice attorney, to assist her in managing the Trump case, claiming that she required a reliable confidant for the position.

However, Michael Roman, one of Mr. Trump’s co-defendants, stated in a filing three weeks ago that the two prosecutors were romantically involved and had taken trips that were funded by Mr. Wade.

Mr. Roman contends that both prosecutors and Ms. Willis’s office should be removed from the case because of this apparent conflict of interest.

Neither Mr. Wade nor Ms. Willis have responded to the claims of a relationship thus far. However, it appeared more and more likely in recent days that Mr. Wade would have to confront the allegations during a divorce.

He was scheduled to testify at the hearing on Wednesday.

The judge abruptly called off the hearing and announced an agreement on Tuesday afternoon.

“We can confirm that while the final details are worked out, this is a temporary agreement in place,” a representative for Ms. Wade’s divorce attorney, Andrea Dyer Hastings, said.

On Tuesday night, Ms. Hastings went on to say that “this does not settle the case, even though it negates the immediate need for a hearing.”

The problems with interim alimony and legal fees, she continued, “have been resolved.” The kids from the couples are now adults.

In 1997, Mr. Wade wed Ms. Wade, and he filed for divorce over two years ago.

Ms. Willis has till this Friday to answer Mr. Roman’s application. It is unclear if she will address the claims about their relationship in her reply.

There was no evidence of a romantic relationship between the prosecutors in the filing submitted by Mr. Roman, a former member of the Trump campaign staff.

However, it stated that those close to them had verified that they had been spotted “in a personal relationship capacity” in Atlanta.

Since Ms. Willis hired Mr. Wade in November 2021, he has received more than $650,000 in legal fees.

According to Mr. Roman’s filing, Ms. Willis took vacations that Mr. Wade

had been “profiting significantly from this prosecution at the expense of the taxpayers,” despite having been paid for. That was the conflict of interest, he claimed.

The case’s fundamental facts—that Mr. Trump and his allies planned to tamper with Georgia’s 2020 presidential election results—remain unaltered by the accusations.

These four include some of Mr. Trump’s most ardent supporters. During a hearing held late last year, Jenna Ellis, one of them, sobbed as she said she regretted what she had done.

The strength of Mr. Roman’s filing and its potential to persuade Fulton County Superior Court Judge Scott McAfee, the case’s presiding judge, are matters of debate among legal experts the prosecution team ought to be dismissed from the court.

In his filing, Mr. Roman also requests the dismissal of the seven felonies that are brought against him.

However, Ms. Willis is facing additional severe complications as a result of the accusations.

Fulton County has started an investigation and requested a number of documents from Ms. Willis, including invoices and payments to special prosecutors; the county commission is unable to dismiss the elected district attorney, though.

It is anticipated that a new commission headed by Republican lawmakers, who oversee prosecutors, will examine Ms. Willis’s behavior and may present a more serious threat.

The legislature has not yet decided how much authority the commission will have, but it will probably have the ability to discipline or dismiss Georgia prosecutors.

Additionally on Tuesday, Mr. Roman’s attorney Ashleigh Merchant, accused the Fulton County District Attorney’s Office of “intentionally withholding information in advance of scheduled evidentiary hearings” and filed a lawsuit against the office.

Ms. Merchant said she had requested a number of documents from the public records office, but she had not received all of them.

These documents included invoices for payments made by the office to Mr. Wade in 2023 and copies of the reimbursements made to Ms. Willis for her travel expenses.
