Governor Greg Abbott, a Republican from Texas, tested the boundaries of what a state can do to enforce immigration laws on Monday when he approved broad new powers that give police the ability to arrest migrants who enter the country illegally and give local judges the authority to order them to leave.

The measure’s opponents have dubbed it the most dramatic attempt by a state to control immigration since the U.S. Supreme Court largely overturned a 2010 Arizona law known as the “Show Me Your Papers” bill.

Federal law enforcement is responsible for enforcing immigration laws, and Texas’ legislation is likely to encounter swift legal challenges.

The law that becomes operative permits any Texas law enforcement official to make an arrest of someone they believe is entering the country illegally in March.

Once in detention, they faced the option of being charged with misdemeanor illegal entry or complying with a Texas judge’s order to leave the country.

If they stay, migrants may be arrested again and charged with more serious felonies.

Abbott projected that there would be a “well over 50%, maybe 75%” decrease in the number of people entering Texas illegally when he signed the legislation in front of a border fence in Brownsville.

He provided no support for that estimate.
