The U.S. Constitution “could not be any clearer,” according to Rep. Jamie Raskin (D-Md.), who stated on Thursday that he believes the 14th Amendment bars former President Trump from holding public office once more.

“This is an opportunity for the justices of the Supreme Court to demonstrate that they genuinely mean it when they discuss originalism and textualism.

In an interview with CNN’s “The Situation Room,” constitutional law expert Raskin stated that the plain language of the Constitution could not be any clearer.

“If Donald Trump’s actions on January 6 and the weeks preceding it do not disqualify him from holding public office again, then who does?” How come they would take a whole clause out of the constitution? Raskin continued.

Thus, they have the chance to act like actual Supreme Court justices now.

Raskin made these comments at the same time that Trump announced his intention to appeal a Colorado Supreme Court decision that ruled him ineligible to run for president in 2024.

In its decision, the court refers to Section 3 of the 14th Amendment, which states that former public servants are prohibited from holding public office for a period of time after they “engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof,” after “having previously taken an oath… to support the Constitution of the United States.”

The Colorado Supreme Court’s decision, according to Raskin in the interview on Thursday, “strikes me as a very straightforward textualist application of the Constitution.

” The wording is very straightforward. The Supreme Court of Colorado awarded it a easy to understand text.”

You cannot hold office again if you have taken an oath to uphold the Constitution and you break that oath by participating in insurrection or rebellion, unless the Congress votes by a two-thirds majority to effectively restore your eligibility.

The Constitution itself states as much,” he said.

According to him, there was an initial proposal to amend the 14th Amendment to prohibit the officials in question not only from running for public office but also from voting.

Not just insurrection or rebellion, but anyone participating in Confederate secession would be covered by the language.

According to Raskin, Republicans in the Senate at the time chose to craft the language that finally narrowed the scope “down to the hardcore bulls-eye of the most egregious offenders ” entered the Constitution.

Raskin continued, “So Donald Trump can definitely vote.”

“It’s just that this measure prevents him from holding office again, and I should mention that Republicans brought the case regarding the Colorado Republican primary under a clause added to the Constitution by radical Republicans in the 19th century.”
